Welcome to Phonout, developed by KnowPhone. These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website (www.phonout.com), and related services. By downloading, installing, or using Phonout, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services.
These Terms apply to all users, including parents, guardians, and children using the app under parental supervision.
1. Acceptance of Terms
By accessing or using Phonout, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
- • You must be at least 18 years old or have parental/guardian consent to use this app
- • Parents/guardians are responsible for monitoring their children's use of the app
- • You agree to use the app lawfully and in accordance with these Terms
2. Description of Service
Phonout is a screen time management application designed to help parents reduce their children's device addiction and promote healthy digital habits.
Key Features:
- • PIN-protected screen locks to control device access
- • Customizable time limits for daily screen usage
- • Automatic lock overlay when time expires
- • Progress tracking and detox journey management
- • Multi-device support (phones, tablets, TVs)
- • Offline-first operation with optional cloud sync
We reserve the right to modify, suspend, or discontinue any feature of the service at any time without prior notice.
3. User Accounts and Registration
Currently, Phonout operates primarily on-device without requiring traditional user accounts. However:
- • You are responsible for maintaining the confidentiality of your 4-digit PIN
- • You must not share your PIN with unauthorized persons
- • You are responsible for all activities that occur under your PIN
- • If premium features are added, you may need to create an account with accurate information
4. Subscription and Billing
Free Service
Phonout is currently offered as a free service with no subscription fees, advertisements, or data selling.
Future Premium Features
If we introduce premium features in the future:
- • Subscriptions will be processed through Google Play Billing
- • All payment information is handled by Google Play (we never store payment details)
- • Subscriptions automatically renew unless cancelled before the renewal date
- • Refunds will be subject to Google Play's refund policy
- • You can cancel subscriptions at any time through your Google Play account
Note: We will provide clear notice and obtain consent before implementing any paid features.
5. User Conduct and Prohibited Activities
You agree not to:
• Attempt to bypass, disable, or manipulate the app's lock mechanisms or security features
• Reverse engineer, decompile, or disassemble the app
• Use the app for any illegal or unauthorized purpose
• Interfere with or disrupt the app's servers or networks
• Collect or harvest any information from other users
• Transmit any viruses, malware, or harmful code
• Misrepresent your identity or impersonate others
Violation of these terms may result in immediate termination of your access to the app.
6. PIN Security and Device Management
The 4-digit PIN is the primary security mechanism for parental control:
PIN Responsibilities:
- • Keep your PIN confidential and secure
- • Choose a PIN that children cannot easily guess
- • Do not share your PIN with unauthorized individuals
- • Change your PIN regularly for enhanced security
Lost or Forgotten PIN:
Since PINs are stored locally on your device for privacy, we cannot recover lost PINs. In case of a forgotten PIN:
- • You may need to uninstall and reinstall the app (losing local data)
- • Contact support for assistance: support@knowphone.in
We are not liable for any loss of data or access resulting from forgotten or compromised PINs.
7. Parental Responsibilities
Phonout is a tool designed to assist parents in managing screen time, but it does not replace active parenting:
- • Parents are solely responsible for monitoring their children's device usage
- • The app is intended for use with parental consent and supervision
- • Parents should have open conversations with children about healthy screen time habits
- • While our locks are designed to be unbreakable, determined children may find workarounds (factory reset, safe mode, etc.)
- • Parents should remain vigilant and use Phonout as part of a comprehensive approach to digital wellness
Phonout is a parenting aid, not a substitute for parental guidance and supervision.
8. Permissions and Device Access
Phonout requires certain device permissions to function effectively:
Overlay Permission: Required to display lock screens over other apps
Exact Alarm Permission: Required for accurate timer functionality
Battery Optimization Exemption: Prevents system from interfering with detox timers
Internet Access: Required for toggle sync (TV app) and analytics
By granting these permissions, you authorize the app to use them solely for their stated purposes as outlined in our Privacy Policy.
9. Intellectual Property Rights
All content, features, and functionality of Phonout, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of KnowPhone and are protected by international copyright, trademark, and other intellectual property laws.
You May Not:
- • Copy, modify, distribute, or create derivative works of the app
- • Use our trademarks, logos, or branding without written permission
- • Remove or alter any copyright, trademark, or proprietary notices
- • Sell, license, or commercially exploit the app or its content
Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to use Phonout for its intended purpose in accordance with these Terms.
10. Disclaimer of Warranties
PHONOUT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
- • Warranties of merchantability, fitness for a particular purpose, and non-infringement
- • That the app will be uninterrupted, error-free, or secure
- • That the app will achieve specific results in reducing screen time
- • That defects will be corrected
- • That the app or servers are free of viruses or harmful components
Your use of Phonout is at your sole risk. We do not guarantee that the app will prevent all unauthorized device access or solve all screen time issues.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KNOWPHONE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF PHONOUT.
This includes but is not limited to:
- • Direct, indirect, incidental, consequential, or punitive damages
- • Loss of data, profits, or business opportunities
- • Device malfunction or data loss
- • Unauthorized access resulting from compromised PINs
- • Children finding workarounds to bypass locks
- • Emotional or psychological impacts
- • Any third-party actions or services (e.g., Google Play)
Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim (currently $0 for free users).
12. Indemnification
You agree to indemnify, defend, and hold harmless KnowPhone , its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- • Your violation of these Terms
- • Your misuse of the app
- • Your violation of any third-party rights
- • Any unauthorized access to your device resulting from sharing your PIN
- • Any dispute between you and your child regarding app usage
13. Termination
By You
You may stop using the app at any time by uninstalling it from your device. Local data will be deleted upon uninstallation.
By Us
We may suspend or terminate your access to Phonout immediately, without prior notice, if:
- • You violate these Terms
- • We suspect fraudulent or illegal activity
- • We discontinue the service
- • Required by law or regulatory authorities
Effect of Termination: Upon termination, your right to use the app ceases immediately. Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to www.phonout.com/terms.
- • Material changes will be communicated via in-app notification or email (if provided)
- • Your continued use of the app after changes constitutes acceptance
- • If you disagree with changes, you must stop using the app
- • We will update the "Last Updated" date at the top of this page
15. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Jurisdiction
Any disputes arising from these Terms or your use of Phonout shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
Informal Resolution
Before initiating formal legal proceedings, we encourage you to contact us at support@knowphone.in to resolve disputes informally.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KnowPhone regarding your use of Phonout and supersede all prior agreements and understandings.
